TERMS AND CONDITIONS

 

Atlas Uncharted (the “Event”)

These Terms and Conditions (“Terms”) govern participation in the Rally organised by Atlas Uncharted (the “Organiser”). By submitting an entry form and paying the registration fee, participants agree to be bound by these Terms.

 

1. Nature of the Event

1.1 The Event is a non-competitive amateur overland endurance event conducted across Morocco, Mauritania and Senegal.

1.2 The Event involves travel through remote and undeveloped regions including desert, off-road, and politically sensitive areas.

 

1.3 The Rally is not a professional motorsport event. It is an adventure activity involving inherent and significant risk.

 

2. Eligibility

2.1 Participants must be at least 18 years of age and hold a valid driving licence recognised in the countries traversed.

 

2.2 Participants are solely responsible for ensuring:

  • Passport validity (minimum 6 months remaining);

  • Required visas and entry documentation;

  • Vehicle registration and import/export documentation;

  • Valid insurance coverage (see Section 9).
     

2.3 The Organiser reserves the right to refuse or revoke participation at its discretion for safety, legal or reputational reasons.

 

3. Acknowledgment of Risk

3.1 Participants expressly acknowledge that the Rally involves serious and uncontrolled risks including, but not limited to:

  • Road traffic accidents;

  • Vehicle rollover or mechanical failure;

  • Remote-area breakdown without immediate assistance;

  • Extreme heat, dehydration, and desert exposure;

  • Medical emergencies;

  • Political instability, civil unrest or armed conflict;

  • Terrorism or security incidents;

  • Natural disasters (including flooding, sandstorms, earthquakes);

  • Border closures and travel disruption;

  • Pandemic-related restrictions.

3.2 Participants voluntarily assume all such risks.

 

4. Waiver and Limitation of Liability

4.1 Participation is entirely at the participant’s own risk.

4.2 To the fullest extent permitted by law, the Organiser, its directors, officers, employees, contractors, sponsors and agents shall not be liable for:

  • Personal injury or death;

  • Damage to or loss of vehicles;

  • Theft or loss of property;

  • Mechanical failure;

  • Delays, rerouting, or abandonment of stages;

  • Any consequential or economic loss.
     

4.3 The Organiser provides route guidance and logistical coordination only. Participants remain solely responsible for:

  • Their driving decisions;

  • Vehicle condition;

  • Compliance with local laws;

  • Personal safety.
     

4.4 Nothing in these Terms excludes liability where exclusion is prohibited by law.

 

5. Indemnity

Participants agree to indemnify and hold harmless the Organiser against any claims, damages, losses, liabilities or legal expenses arising from:

  • Their participation in the Rally;

  • Their vehicle;

  • Their breach of local law;

  • Injury or damage caused to third parties.
     

 

6. Vehicle Responsibility

6.1 Vehicles must be roadworthy and suitable for desert and remote travel.

6.2 Mandatory safety equipment includes:

  • First aid kit;

  • Emergency communication device (satellite phone or equivalent);

  • GPS tracking/location device;

  • Minimum prescribed water reserves;

  • Vehicle recovery equipment;

  • Fire extinguisher.
     

6.3 The Organiser may conduct safety checks but assumes no responsibility for vehicle condition.

 

7. Medical & Security Support

7.1 The Organiser will arrange:

  • A medic and dedicated medical vehicle to follow the route;

  • Emergency response coordination;

  • Private or government security escorts where deemed appropriate.
     

7.2 Such support does not eliminate risk and does not create a duty of care beyond reasonable coordination.

 

8. Compliance with Law

Participants must:

  • Comply with all local road laws;

  • Observe speed limits and safety signage;

  • Avoid reckless or dangerous driving;

  • Respect local communities and customs.
     

Failure to comply may result in immediate removal from the Rally without refund.

 

9. Insurance

Participants must obtain and maintain:

  • Comprehensive vehicle insurance valid in all countries travelled;

  • Third-party liability insurance;

  • Medical and emergency evacuation insurance covering motorsport/adventure activity.
     

Proof of insurance may be requested prior to departure.

 

10. Cancellation Policy

10.1 If participants cancel their registration, 50% of the original registration fee is refundable until October 31st 2026.

10.2 Cancellation must be made using the official cancellation form (available by request).

10.3 After October 31st 2026, the registration fee is non-refundable unless the Rally is cancelled by the Organiser.

10.4 Entries are not transferable or saleable.

10.5 The Organiser reserves the right, at its sole discretion, to:


• Cancel the Rally;
• Postpone the Rally;
• Modify the duration, route, destination, or structure of the Rally;
• Reduce or expand the geographic scope of the Rally;
• Transfer registrations to alternative dates;
• Offer full, partial, or discretionary refunds;
where deemed necessary for operational, safety, security, legal, political, financial, logistical, environmental, or force majeure reasons.

10.6 Participants acknowledge that expedition travel in remote regions involves changing circumstances and that flexibility is an essential part of the nature of the Event.

10.7 The Organiser shall not be liable for any indirect losses, travel costs, accommodation costs, transport bookings, visa costs, or other expenses incurred by participants in connection with any cancellation, postponement, route modification, or rescheduling of the Rally.

 

11. Force Majeure

11.1 If the Organiser is forced to cancel, postpone, suspend, reroute, or significantly modify the Rally due to force majeure, the Organiser may take such action at its sole discretion.

11.2 Force majeure includes, but is not limited to:


• War or threat of war;
• Terrorism;
• Armed conflict;
• Civil unrest or political instability;
• Pandemics or epidemics;
• Natural disasters;
• Earthquakes;
• Flooding;
• Sandstorms;
• Governmental restrictions;
• Border closures;
• Travel warnings;
• Fuel shortages;
• Extreme weather conditions;
• Infrastructure or security failures.

11.3 The Organiser may:


• Reschedule the Rally;
• Transfer registrations to a future event;
• Modify the route or destination;
• Provide full or partial refunds;
• Retain part of the entry fee to cover non-recoverable operational costs.

11.4 Participants acknowledge that certain operational expenses may already have been committed prior to cancellation and may not be recoverable by the Organiser.

 

12. Route Changes and Discretion

The Organiser reserves the absolute right at any time and without prior notice to:


• Modify routes;
• Cancel or shorten stages;
• Change accommodation or camps;
• Alter border crossings or destinations;
• Limit travel to certain countries or regions;
• Suspend, delay, or terminate the Event;
• Remove or refuse participants;

where deemed necessary for safety, security, operational feasibility, legal compliance, environmental concerns, or the overall integrity of the Rally.

Such decisions shall be final and binding.

 

13. Photography and Media

Participants grant the Organiser the right to use photographs, video, and media content captured during the Rally for promotional purposes without compensation.

 

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

15. Entire Agreement

These Terms constitute the entire agreement between the Organiser and participants and supersede all prior representations.
